Quick answer

UK Form SMP1 ("Why I cannot pay you Statutory Maternity Pay") is the official DWP and HMRC form an employer must complete and give to a pregnant employee within 7 days of deciding she does not qualify for Statutory Maternity Pay (SMP) — for example because she has less than 26 weeks' continuous service by the Qualifying Week (15th week before the Expected Week of Childbirth) or her average weekly earnings are below the Lower Earnings Limit. The employer returns the employee's original MAT B1 maternity certificate together with the completed Form SMP1 so she can claim Maternity Allowance from DWP on Form MA1. What is Form SMP1?

Need to issue Form SMP1 to an employee who does not meet the 26-week service or earnings test for Statutory Maternity Pay, or received a flat SMP1 PDF alongside your MAT B1 certificate to claim Maternity Allowance? Just like Form SSP1 for sick pay, the official GOV.UK SMP1 form is distributed as a PDF that many HR teams and small businesses struggle to fill cleanly in standard browser viewers. JustFill detects every checkbox, date box, and earnings table on Form SMP1 so UK employers, payroll bureaus, and employees can complete it in the browser without printing and handwriting.

Who fills out Form SMP1?

  • UK employers, HR managers, and payroll administrators issuing Form SMP1 within 7 days of deciding an employee cannot receive Statutory Maternity Pay
  • Accountants and outsourced payroll bureaus preparing SMP1 refusal notices and returning the employee's MAT B1 certificate
  • Pregnant employees checking Part A and Part B of their SMP1 before submitting it with Form MA1 and their original MAT B1 to DWP for Maternity Allowance

Field-by-field breakdown

What each section of Form SMP1 asks for. JustFill’s AI will detect these fields automatically when you upload the PDF — review the breakdown below so you know what to enter.

Part A — Employee's details & MAT B1 Expected Week of Childbirth (EWC)

Employee's surname, first name(s), National Insurance number, home address and postcode, Expected Date of Childbirth from the MAT B1 certificate, Sunday of the Expected Week of Childbirth (EWC), and the Qualifying Week (15th week before the EWC).

Part B — Why the employer cannot pay Statutory Maternity Pay (SMP)

Tick-box reasons why SMP is not payable: not employed continuously for at least 26 weeks into the Qualifying Week, average weekly earnings in the 8-week relevant period below the Lower Earnings Limit (£125/week for 2025/26; check current April threshold), late notice without reasonable excuse, MAT B1 medical evidence not provided in time, or in legal custody.

Part B — Relevant period earnings breakdown (when earnings are too low)

Start and end dates of the 8-week relevant calculation period, gross pay paid in that period, and calculated average weekly earnings.

Part C — Employer declaration, contact details & MAT B1 return

Employer name, address, postcode, telephone number, employer's signature, printed name, position, date, and confirmation that the employee's original MAT B1 certificate is being returned to her.

Common mistakes to avoid

  • 1Keeping the employee's original MAT B1 maternity certificate — when issuing Form SMP1, the employer MUST give the original MAT B1 certificate back to the employee (keeping a photocopy for payroll records) because DWP requires the original MAT B1 with Form SMP1 and Form MA1 for Maternity Allowance.
  • 2Misidentifying the Qualifying Week — the Qualifying Week is the 15th week before the Expected Week of Childbirth (running from Sunday to Saturday), and the employee must have at least 26 weeks of continuous employment with the same employer ending with the Qualifying Week.
  • 3Waiting too long to issue Form SMP1 — UK law requires the employer to give the employee Form SMP1 within 7 days of making the decision that she does not qualify for SMP, and no later than 28 days after she gave notice of her maternity absence.
  • 4Sending Form SMP1 to HMRC — Form SMP1 is given to the employee, who sends it to Jobcentre Plus / DWP with her Maternity Allowance claim.

Form SMP1 example — what a filled-out form looks like

A fictional UK employee, Hannah Rose Example, joined Sample Retail Ltd 14 weeks before her Qualifying Week. Because she does not have 26 weeks' continuous service with Sample Retail Ltd by the Qualifying Week, HR completes Form SMP1 and returns her original MAT B1 certificate so she can claim Maternity Allowance from DWP.

Part A — Employee Name, NI Number & MAT B1 Dates

EXAMPLE, HANNAH ROSE · NI No: QQ 12 34 56 C · Baby due date (MAT B1): 18 02 2027 · EWC begins: 14 02 2027 · Qualifying Week ends: 07 11 2026

Calculates the Sunday of the Expected Week of Childbirth and the 15th week before it (the Qualifying Week).

Part B — Reason SMP Cannot Be Paid

☑ Not employed by me for a continuous period of at least 26 weeks into the Qualifying Week (employment started 20 07 2026)

She meets the earnings test across her recent employment history for Maternity Allowance, but joined this specific employer after the 26-week cut-off for SMP.

Part C — Employer Declaration & MAT B1 Return

Sample Retail Ltd, 50 Sample High St, Manchester, ZZ99 9ZZ · Original MAT B1 returned to employee · Signed 12 10 2026

The employer signs Part C and returns the original MAT B1 certificate with Form SMP1.

These values are made up. They are here to show what belongs on each line, not to be copied — every name, number, and address on your own Form SMP1 has to be your own.
