DECLARATION OF JANE SAMPLE IN SUPPORT OF DEFENDANT'S MOTION TO CONTINUE TRIAL
Rule 3.1115 requires a declaration to name the declarant and identify the motion it supports. The form's printed title is just "Declaration", so put this on the first line of the body.
1. I am the defendant in this action. I have personal knowledge of the facts stated in this declaration and could testify to them if called as a witness.
State who you are and how you know the facts. A declaration is evidence, not argument.
2. Trial is set for October 12, 2026. On October 5, 2026 I am scheduled for surgery, and my surgeon has advised a four-week recovery. A copy of the scheduling letter is attached as Exhibit A.
One fact per sentence, dated, with the supporting document identified. Attach the exhibit behind the form.
3. I respectfully ask the court to continue the trial to a date after November 9, 2026. I have not requested a continuance before in this case.
