California Judicial Council Form MC-030 (Declaration) is the universal 1-page sworn statement signed under penalty of perjury under Code of Civil Procedure section 2015.5 used across civil motions, unlawful detainers, family law Requests for Order (FL-300), and probate supplements. Under California Rules of Court, Rule 3.1115, the caption or first line of the declaration body must explicitly identify the name of the declarant and the specific motion or proceeding the declaration supports or opposes.

Rule 3.1115 requires a declaration to name the declarant and identify the motion it supports. The form's printed title is just "Declaration", so put this on the first line of the body.
1. I am the defendant in this action. I have personal knowledge of the facts stated in this declaration and could testify to them if called as a witness.
State who you are and how you know the facts. A declaration is evidence, not argument.
2. Trial is set for October 12, 2026. On October 5, 2026 I am scheduled for surgery, and my surgeon has advised a four-week recovery. A copy of the scheduling letter is attached as Exhibit A.
One fact per sentence, dated, with the supporting document identified. Attach the exhibit behind the form.
3. I respectfully ask the court to continue the trial to a date after November 9, 2026. I have not requested a continuance before in this case.
