Form G-28 is the notice a licensed attorney or DOJ-accredited representative files to appear on a client's behalf in an immigration matter before USCIS, ICE, or CBP. Once it is on file, the agency recognizes the representative, sends case correspondence to them, and can discuss the case with them — Part 4 checkboxes even let the client route original notices and secure documents such as a green card or EAD to the representative's office. There is no filing fee (it is listed at $0 on the USCIS G-1055 fee schedule), and the form is filed with the related application, petition, or appeal, or mailed to the office where a case is already pending. The current 4-page PDF is the 09/17/18 edition; USCIS still accepts the 05/23/18 edition and has said a new edition is coming, so check the edition date on uscis.gov/g-28 before filing. Common mistakes to avoid

  • 1Missing signatures — USCIS calls the unsigned form its most common G-28 mistake and rejects any unsigned form; the client signs Part 4 and the representative Part 5, and stamped or typewritten names are not accepted (a scanned copy of an ink signature is fine)
  • 2Mixing pages from different form editions — every page must carry the same edition date (currently 09/17/18, with 05/23/18 also accepted) or USCIS may reject the form
  • 3Writing the client's name differently than it appears on the underlying filing — on a petition that means the petitioner's name, exactly as entered on that form
  • 4Selecting the wrong agency or client role in Part 3, or leaving out the form numbers and receipt number, so the appearance never attaches to the intended case
  • 5Mailing a subsequent G-28 for a pending case to a lockbox — USCIS says to send it to the office where the case is pending or to the return address on the last notice you received, and to give the receipt number in Part 3, Item 4 so it attaches to the right file
  • 6Highlighting, using correction fluid, graying out any part of the form, or skipping the Part 2 eligibility items (1.a–1.d for attorneys, 2.a–2.c for accredited representatives) — the instructions say USCIS rejects a G-28 without them, and the USCIS page warns that an improperly completed G-28 is processed as if no representative was named
